The crux of the matter with medical certificates: Proof or pretense?
Presumably every line manager or HR manager is familiar with it and has been annoyed by it: as soon as a dismissal is imminent or tensions arise in an employment relationship, the employee calls in sick. This prevents or thwarts a dismissal because it would be null and void. The same process can also be seen after a valid dismissal, i.e. before the illness and therefore before the start of the suspension period. What both cases have in common is that this delays the termination of the employment relationship and triggers the employer’s obligation to continue paying wages.
